The words “we”, “us” and “our” in these terms and conditions mean eMAKER Ltd.
This website
We make this website accessible worldwide to anyone with an Internet connection. If you use this website or you buy our goods then you are subject to these terms and conditions.
These terms and conditions may be superseded by local laws, but eMAKER Ltd is bound by the law in England and Wales (see below).
The content of this website is copyright and is the property of eMAKER Ltd. The material on this website may be displayed solely for your information. It may not be copied nor modified without our written permission.
This site contains information, facts and opinions from us and from various people and organisations associated with us. It is provided on an as-is basis without warranties of any kind, either express or implied, including (but not limited to) warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are imposed by and incapable of exclusion, restriction or modification under the laws of England and Wales applicable to these terms and conditions. We neither endorse nor are we responsible for the accuracy or reliability of any opinion, advice or statement contained within this site. Our goods, in contrast, are covered by warranty. See below.
Your use of this site is at your own risk. We shall not be liable to you or anyone else for any loss or injury or any damages at all arising out of your access to, or your inability to access, this site. You hereby waive any and all claims against us arising out of your use of the site and any other sites owned by eMAKER Ltd.
Terms and Conditions of Sale
This section of our website sets out terms and conditions which apply specifically to the sale of goods by us to you.
Warranty
All of the physical products supplied by us are covered by a twelve-month quarantee following your shipment date. This completely covers you against defective or missing products or product components.
Please note that – in the case of kits – this warranty will not apply if eMAKER build instructions are not followed. Links to build instructions for each of our kits are provided on the web pages where each kit is for sale. eMAKER is not responsible for mistakes made during building, failure to follow the instructions, and deliberate deviations from the instructions.
Warranty claims will be considered on a case-by-case basis. All warranty replacements are at the discretion of eMAKER Ltd. Damage and breakages will require evidence of failure, so the cause can be diagnosed.
We appreciate RepRaps are designed to be customised, and we understand that customers may, after consideration, deliberately deviate from the instructions. Should you break anything, all the original parts are available individually from us at very reasonable prices. We are not responsible for replacing parts if you cause damage to them through modification, but we will continue to support you and to advise the best course of action to repair any damage. The warranty will still cover parts of kits unrelated to your modifications.
Warranty parts are sent by the normal postal service – standard Royal Mail postage in the UK, airmail elsewhere. You can pay extra for tracking and/or courier delivery.
Purchasing from us
To purchase from us you must either be over 18 or have the permission of your parent or guardian. By submitting your order you are offering to buy the goods at the price set out in the order.
A delivery charge may be payable by you. The relevant delivery charge will always be as shown on your order at the time you place the order.
If goods are delivered to you outside the EU there may be customs and other import charges to pay in addition. Those are your responsibility, and we do not calculate nor show those charges.
We are not obliged to supply the goods to you until we have confirmed that we have both accepted your order and that it has been dispatched. No contract will exist until we have dispatched the goods. Any goods on the same order the dispatch of which we have not confirmed to you will not form part of that contract.
You do not own the goods until we receive payment in full.
If your order has already been submitted and you identify a mistake, please contact us at our e-mail address above immediately. Please do this before we confirm our acceptance of your order. We may be unable to rectify mistakes after that, although you still have the right to cancel as described in our Cancellation and Returns Policy below. In addition to our guarantee, you have certain legal rights to a cooling off period after the goods have been delivered to you. Details of these rights, and instructions on what you need to do to exercise them, are set out in our Returns Policy. We will also remind you of these when we send our confirmation and acceptance of your order.
Prices are checked regularly. However, if we find the price has changed when we receive your order we will contact you and ask if you wish to proceed. If you confirm that you do wish to proceed then please remember that we will still not be under an obligation to supply the goods until we have confirmed that we both have accepted your order and that it has been dispatched. No contract will exist until we have confirmed this.
The kit contents and components listed on this webshop are subject to improvement without notice. Complete RepRap kits will always be provided with all components required to get you printing. Hardware RepRap kits will always be provided with all components required to get you printing except the 3D-printed parts. The colour of the sample filament supplied with each kit will not always match that illustrated. Assembled components will always be complete, tested and functional. All images on the site are for illustrative purposes and not necessarily accurate.
Availability and Delivery
Our current lead times for the kits and spares orders are published on the FAQ page.
If any goods are not in stock or, for any other reason, goods cannot be delivered to you by the planned date, we will contact you giving you details of the likely delivery date. If you would rather not wait, you will have the right to cancel your order then. If we have already taken payment for your order, we will re-credit your credit or debit card or Paypal account in full for the goods for which you have cancelled your order.
Russian shipping addresses – Please note that owing to restrictions put in place by shipping companies we are unable to ship our kits to some parts of Russia. If you would like to place an order for delivery to Russia, we are happy for you to arrange your own collection from our shipping address. If you would like to do this, please contact us and we can raise an invoice without shipping included. Once the kit has left eMAKER premises on the way to Russia we are no longer responsible for it, therefore any loss or damage in transit will be the customer’s responsibility.
Damaged Goods
You should inspect the goods when you receive them for damage. If you find damaged goods you must tell us as soon as possible and we will arrange for their return, at no cost to you. If the goods are found to be damaged prior to delivery to you, we will replace the goods or refund the price paid by you at your choice. In the event your goods are damaged please contact us at our e-mail address above for arrangements to be made.
Cancellation and Returns
For United Kingdom customers the United Kingdom’s Distance Selling Regulations 2000 provide you with a right to cancel your order for goods at any time up to the end of the fourteenth day following the day after the day on which you received the goods. You do not need to give us any reason for cancellation.
If you wish to cancel your unfulfilled order please email us at our e-mail address above with details of your cancellation.
If you have already received the goods please email us at our e-mail address above and we will provide instructions for their return to us.
Until you have returned the goods to us, you must keep them in your possession and take reasonable care of them.
We will credit you with the price of the cancelled goods and outward postage from us, but not your return postage.
If for any reason you are not satisfied with any goods bought from us you may return them to us within 14 days of the goods being delivered for a full refund or an exchange provided that the goods are returned to us in their original condition and carefully packaged.
To return goods under this Cancellation and Returns Policy please first contact us at our e-mail address above for arrangements to be made. (Or you can use paper post.)
